The first day on the job, the new Manhattan District Attorney issued a memo to assistant district attorneys outlining new prosecutorial policies of the Manhattan DA's office. The so-called Day-One Memo, among other things, essentially decriminalizes numerous offenses that some years ago no one could have thought would go unprosecuted. Will it make for a more just, equitable society, or is it our ticket into lawlessness and anarchy? If resisting arrest is not a crime, and armed robbery is equal to petit larceny, will police officers have any incentive to put themselves in harms way to prevent crimes that are not prosecutable?
